You qualify for an HSA if you meet the following conditions: Incorporated business No arm’s length employees You receive T4 income To qualify as an incorporated professional, you must have no arm’s length employees. You may add your spouse as an employee and your dependent children may be added. You must purchase a Group HSA if you have arm’s length employees. You still qualify for an HSA if you receive dividends from your corporation. However, it is strongly advised that you receive some T4 income in order to establish the necessary employer – employee relationship in the HSA contract.
